PRICING--ONLINE MERCHANDISE

• Products are offered for sale through the Site at the prices displayed on the Site at the time order and are subject to change from time to time. In some cases the same or similar merchandise may be offered for sale in the Le Creuset Signature or Outlet stores. Some products may be offered at promotional prices either in Le Creuset stores or on the Site based on the promotions available to the Site or the stores, so the prices may not be the same at any given time.
• Prices and other promotional offers (such as coupons and additional discounts) offered at Le Creuset stores may not be applied toward purchases from this Site. Similarly, prices and other promotional offers (such as promotion codes and free shipping) from this Site may not be applied toward purchases from Le Creuset stores or stores of other retailers.
• This Site may contain typographical errors or inaccuracies and may not be complete or current. We reserves the right to correct any errors, inaccuracies or omissions (including after an order has been submitted), and to change or update information at any time without prior notice. Such errors, inaccuracies or omissions may relate to pricing and availability, and we reserve the right to cancel or refuse to accept any placed order based on incorrect pricing or availability information. TERMS OF PAYMENT

• Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order or shipping of Products. All orders are subject to credit approval before they can be fulfilled.

• Card authorization takes place the day after the order is placed. Once authorized, funds are reserved for seven days. Payment (transfer of funds) does not occur until the order ships. The total dollar amount of your order, including any applicable tax and shipping and handling, is allocated at the time your card is approved, although payment (transfer of funds) does not occur until the order ships. If the amount charged exceeds your credit limit, you will be notified during the checkout process and the order for that amount will not be accepted.
• You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes and shipping and handling, if any.
• Gift Cards
• We also accept Le Creuset e-Gift Cards. You can purchase a gift card online here or by calling Consumer Services at 1-877-273-8738. Gift cards purchased through this Site are electronic and delivered via email to the recipient specified at time of purchase.
• After your electronic gift card is emailed to the recipient, you will receive an email confirmation stating your order has been shipped. This confirmation will be sent to the email address you entered during the checkout process.
• To redeem a gift card on this Site, select “Gift Card” as your payment method during the checkout process. You will be instructed to enter the gift card number and the amount from the gift card that you wish to apply to your order.
• If the value of the gift card is less than the total cost of your order, you will be asked to provide your credit card information to cover the remaining balance.
• If your order total is less than the value of your gift card, the unused value will remain on the card for a future purchase.
• Gift cards do not expire.

SALES TAX

The applicable sales tax is automatically calculated for orders through this Site. The sales tax is displayed during the checkout process.

SHIPPING AND HANDLING

• General Shipping Terms
• Products ordered through this Site are shipped only to addresses in the continental United States, Alaska, Hawaii and Puerto Rico; however delivery to Alaska, Hawaii and Puerto Rico will be subject to an additional charge.
• Merchandise will only be sent to valid street addresses; there is no delivery to P.O. Boxes or APO/FPO addresses.
• Shipment to multiple locations from a single order is currently not available. If you want to ship items to multiple addresses, you will need to process each order as a separate transaction. Shipping charges are calculated for each ship-to-address.
• Multiple items ordered at the same time may not always be shipped together. Your shipment confirmation email will have tracking numbers for each shipment related to an order.
• You will pay all shipping and handling charges specified during the ordering process. Your shipping charges are generally based on the total merchandise amount per address and the delivery options that you choose. Based on size and/or weight, certain items bear a shipping surcharge. Shipping surcharges are shown on product pages before you place an item in your shopping cart, and will be added to the total shipping cost of your order.
• Free shipping promotions are available only through this Site and effective through specified end dates (11:59 p.m. EST/EDT). Does not include retailer-exclusive items or colors. Applies only to UPS Ground 3 - 5 Day Shipping.
• Delivery and Delivery Options
• We will arrange for shipment of the products to you through a carrier (currently UPS) as described below. We offer several modes of delivery for your order. These include Standard UPS Ground, UPS 2-Day and UPS Next-Day delivery
• As to Standard UPS Ground, expect delivery within four to six business days after order processing.
• As to 2nd Day Delivery, expect delivery within two business days after order processing.
• As to Next Day Delivery, expect delivery the next business day after order processing.
• Please refer to the shipping and handling chart and list of standard shipping fees to each address by shipping method and order value that you can access here.
• Track your order through the UPS website using the UPS tracking number provided in your shipment's confirmation e-mail.
• Weekend and holiday delivery is not available.
• We will send an e-mail after order approval acknowledging your order and provide an anticipated shipping date. A follow-up e-mail will be sent when the merchandise has left our fulfillment center. That e-mail will contain a UPS tracking number. Clicking on that number will bring you to the specific UPS page for your shipment where you can track the shipment.
• Shipping and delivery dates are estimates only and are not guaranteed by us. We are not liable for any delays in shipments. If you have not received your order within the estimated delivery time, please use the tracking number and link to contact UPS.
• Damage or Loss During Shipping
• Title and risk of loss pass to you upon our transfer of the products to the carrier at our facilities.
• LeCreuset.com is not responsible for any damages or losses that may occur during transit. Please contact UPS regarding any such damages or losses.
• Order Processing Time
• In-stock merchandise is usually processed and placed into the hands of the carrier from our fulfillment center within three business days of the order's approval though many orders placed on a business day before 2:00 p.m. EST and approved are placed in to the hands of our carrier that same day (and many orders placed and approved after 2:00 PM EST on a business day ship the next business day).
• We do not process orders on national or state holidays such as Independence Day or Thanksgiving Day.
• Order Cancellation and Limits
• We reserve the right to question, refuse or cancel any order that we believe may be made with malicious intent or may violate our policies.
• All orders are subject to product availability.
• For fairness and quality service for all our customers, we reserve the right to limit order quantities.
• Messages and Gift Wrapping
• At this time, you can create a personalized message for gift card purchases only. There is an area on the product page for you to create a message.
• We do not currently provide gift wrapping for online sales.

RETURNS, EXCHANGES AND WARRANTY CLAIMS

• We believe the quality and craftsmanship in the products we offer through the Site will provide years of satisfaction. However, if within 45 days you are not completely satisfied with your purchase, please return the item for an exchange or refund of its value by following the terms below.
• In addition, each original item that we sell through this Site comes with a limited warranty, which you may find in the box that included the item. You may also find our current warranties for some items here.
• Please refer to the warranty before attempting to return the item. We reserve the right to determine if the product has been used in a manner that would violate the warranty.
• THE LIMITED WARRANTY INCLUDED WITH THE ITEM PURCHASED GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. AMONG OTHER LIMITATIONS OUR WARRANTIES MAY LIMIT THE WARRANTY PERIOD DURING WHICH WARRANTY CLAIMS MAY BE MADE AND DISCLAIM ALL WARRANTIES (INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) OTHER THAN THE EXPRESS WARRANTIES PROVIDED. THE SPECIFIC WARRANTY TERMS MAY LIMIT YOUR REMEDY TO REPAIR OR REPLACEMENT OR SOME OTHER REMEDY (SUCH AS A REFUND), AND THOSE TERMS WILL CONTROL. OUR LIABILITY WITH RESPECT TO ANY PRODUCT WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR A DEFECTIVE PRODUCT THAT YOU HAVE PURCHASED THROUGH THE SITE. WITHOUT LIMITING THE FOREGOING WE WILL NOT BE LIABLE FOR ANY LOST REVENUE OR PROFITS, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT GOODS OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. HOWEVER, SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, PLACE RESTRICTIONS ON CERTAIN DISCLAIMERS, OR PREVENT THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
• The following terms apply to all returns and exchanges, including for warranty claims:
• To return or exchange an item, you must phone our Consumer Services to obtain a Returns Authorization Merchandise (RMA) number. The toll-free number for Consumer Services is 1-877-273-8738. The RMA number will allow us to associate your returned item with your purchase, reducing the possibility of a handling discrepancy that might occur when the product is received by our distribution center.
• When returning an item, please complete the returns form on back of the packing slip included with your shipping. Include the completed packing slip with your return to allow us to process your return quickly and accurately. Use a shipping carrier most convenient for you, and send the package to:

• The original receipt or gift receipt is required for all returns.
• Returns with the original purchase receipt will be exchanged or refunded in the original tender. Returns with a gift receipt will be exchanged or refunded with a merchandise credit for the value indicated on the gift receipt.
• For gift card returns, the full value must remain on the gift card. The full amount will be credited to the buyer's credit card.
• Please allow 10 - 14 days for the return to be processed following receipt of your return.

USE OF PERSONAL INFORMATION AND PRIVACY POLICY

• You understand and agree that we may use, process or share information, including personal and transactional information, obtained from your visits to the Site and from other activities on the Site, including any orders through the Site, subject to the limitations of our Privacy Policy, as it is amended from time to time. FORCE MAJEURE.

We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

GOVERNING LAW AND JURISDICTION.

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of South Carolina without giving effect to any choice or conflict of law provision or rule (whether of the State of South Carolina or any other jurisdiction).

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of South Carolina although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
